Abstract

La doble prejudicialidad es un fenómeno jurídico-procesal que se erige como un nítido exponente de las dificultades que comporta articular de manera armoniosa el peculiar sistema judicial compuesto de la Unión Europea. En particular, esta figura pone de manifiesto la complejidad de conciliar los intereses nacionales y supranacionales en la concreta esfera del control judicial del Derecho nacional y europeo a través del específico diseño de la relación entre la cuestión prejudicial y la cuestión de constitucionalidad. Recientes pronunciamientos judiciales emanados de los Tribunales Constitucionales de Italia y España dotan de interés renovado una cuestión estructural mediante resoluciones que ofrecen soluciones operativas diferentes ante un mismo problema jurídico en cada uno de tales Estados miembros.

ual preliminarity is a clear example of the difficulties involving the search for a harmonious articulation of the compound judicial system of the European Union. This legal figure clearly reveals the complexity of reconciling national and supranational interests in the particular sphere of the judicial review of national and European law. Recent judicial decisions delivered by the Italian and Spanish Constitutional Courts update a structural concern due to judgments which provide different outcomes for the same legal problem. In essence, the present article addresses the issue of the compatibility of constitutional principles of the European Union legal order with the centralised model of judicial review.
