El presente trabajo tiene la finalidad de exponer qué papel tiene la Policía Judicial en el proceso penal. En él, podremos observar su composición y su regulación en el sistema jurídico español. Se tratará su máxima problemática, que es su dependencia respecto a las Autoridades Judiciales y sus superiores orgánicos. Además, veremos los principios que serán la base para la realización de sus funciones, qué funciones realiza y en qué momento se desarrollan. Asimismo, hablaremos de forma más concreta, de la manera de proceder de la Policía Judicial cuando se trate de delitos con autores menores de edad con responsabilidad penal y en los delitos de violencia de género. Y finalmente, se hará referencia al atestado policial, que es donde la Policía Judicial reproducirá todas sus actuaciones en forma de documento. En este apartado veremos que diligencias se incorporarán al mismo, cuál es su destino, en que consiste el secreto del atestado, y por último qué valor tiene.

The present work has the purpose of exposing the role of the Judicial Police in the criminal process. In it, we can observe its composition and its regulation in the Spanish legal system. It will deal with its maximum problem, which is its dependence on the Judicial Authorities and their organic superiors. In addition, we will see the principles that will be the basis for the performance of its functions, what functions it performs and when they are developed. We will also talk more specifically about the way the Judicial Police proceed when dealing with crimes involving minors under criminal responsibility and crimes of gender violence. And finally, reference will be made to the police report, which is where the Judicial Police will reproduce all its actions in the form of a document. In this section we will see what diligences will be incorporated into it, what is its destiny, what is the secret of the attestation, and finally what is its value.
