La legítima defensa

Abstract

A lo largo de la historia el concepto de la Legítima Defensa ha evolucionado desde sus inicios hasta la actualidad, aunque muchos historiadores opinan que la Legítima Defensa no tiene historia ya que es tan antigua como el hombre. La Legítima Defensa es una autorización que otorga el Estado a las personas para actuar cuando se dan los requisitos señalados en el art. 20.4 del Código Penal: agresión ilegítima, necesidad de defensa y falta de provocación por parte del defensor. ya sea para defender un bien personal o para actuar en los casos en se cause una lesión o se pongan en peligro la vida de otras personas.También nos encontramos con esta autorización para actuar en los casos en se cause una lesión o se pongan en peligro la vida de otras personas. También en los casos en que las Fuerzas y Cuerpos de Seguridad deben hacer uso de su arma reglamentaria de forma proporcional frente a una posible agresión ilegítima, siendo este el campo donde surgen mayores problemas de justificación de la utilización de esta figura a la hora de delimitar si la fuerza empleada para repeler la agresión es proporcionada o no. Por otro lado, destaca la diferencia entre los bienes jurídicos individuales o personales y los bienes colectivos ya que en estos últimos no cabe obrar bajo legítima defensa permitiéndose únicamente el uso de la legítima defensa para la protección de bienes jurídicos personales o de terceros.

Throughout history the concept of the Legitimate Defense has evolved from its beginnings to the present, although many historians believe that the Legitimate Defense has no history since it is as old as man. The Legitimate Defense is an authorization granted by the State to people to act when the requirements indicated in art. 20.4 of the Penal Code: illegitimate aggression, need for defense and lack of provocation on the part of the defender. We also have this authorization to act in cases where an injury is caused or other people's lives are endangered. Also in cases in which the Security Forces and Corps must make use of their regulatory weapon in a proportional manner in the face of possible illegitimate aggression, this being the field where greater problems of justification of the use of this figure arise when delimiting whether the force used to repel aggression is proportionate or not. On the other hand, it highlights the difference between individual or personal legal assets and collective assets because in the latter, it is not possible to act under selfdefense, allowing only the use of this figure for the protection of personal or third-party legal rights. Finally, a series of relevant and mediatic cases are presentedthroughout the work in which the concession or not of the Legitima Defenseexemption plays a veryimportant role.
