En el presente TFG trataremos en primer lugar el derecho fundamental a la inviolabilidad domiciliaria del art. 18.2 CE en el marco del ordenamiento jurídico español. A continuación, realizaremos un análisis jurídico y práctico en lo que respecta a la diligencia de “la entrada y registro” con el objetivo de poder tener una visión más amplia de la evolución que ha acontecido sobre tal concepto. En segundo lugar, describiremos en la medida de lo posible aquellas estancias que pueden ser consideradas como domicilios y aquellas que, al contrario de lo que pudiera pensarse, no son consideradas a efectos legales como domicilio. A continuación, describiremos las situaciones legales que permiten al sistema judicial hacer excepciones a la aplicación del derecho fundamental de inviolabilidad de domicilio. Haremos mención en este apartado sobre las condiciones que deben darse en dichas situaciones, así como su base jurídica, con el fin de preservar siempre el derecho fundamental del art. 18.2 CE. Posteriormente mencionaremos cuales son las funciones de las personas que intervienen en una diligencia de entrada y registro, así como su base jurídica. Trataremos de describir aquellas situaciones en las que se pueda cometer un registro irregular, bien por no respetar las normas vigentes, o bien por no reunir los requisitos necesarios para la correcta realización de una entrada y registro en un domicilio. Por último, mencionaremos los métodos que utilizan actualmente las unidades policiales para realizar una entrada y registro en domicilio.
In the present TFG we will treat first of all the fundamental right to the home inviolability of the art. 18.2 CE in the frame of the Spanish juridical arranging. Next, we will conduct a legal and practical analysis regarding the diligence of "entry and registration" in order to have a broader view of the evolution that has occurred on this concept. Secondly, we will describe to the extent possible those stays that can be considered as domiciles and those that, contrary to what could be thought, are not considered for legal purposes as domicile. We will then describe the legal exceptions that allow the judicial system to make exceptions to the application of the fundamental right of inviolability of domicile. We will mention in this section on the conditions to be given in these exceptions, as well as their legal basis, in order to always preserve the fundamental right described in AR. 18.2 of the EC. We describe what are the functions of the people involved in an entry and registration diligence, as well as their legal basis. Finally, we will try to describe those situations in which an irregular register can be made, either by not respecting the current rules, or by not meeting the necessary requirements for the correct completion of an entry and registration in a domicile. Finally, we will mention the methods currently used by police units to make an entry and registration at home.
