El administrador de hecho en las sociedades de capital

El concepto de administrador de hecho aparece por vez primera en el Derecho positivo español en el Código Penal de 1995. Con posterioridad, ha en-contrado acomodo en distintos textos legislativos, de entre los que destaca, en el ámbito del Derecho privado, la normativa societaria y concursal. El desarrollo ju-risprudencial de la figura, iniciado antes incluso de su reconocimiento legal, ha ido enriqueciendo el concepto en cuanto a tipología y casuística.
