El derecho al secreto de las comunicaciones en el marco del proceso penal

Abstract

Pese a que la jurisprudencia ha suplido con buen criterio, durante cerca de 30 años la pasividad del legislador en relación a una medida de investigación penal que afecta al derecho fundamental al secreto de las comunicaciones, el pasado año 2015 se procedió a reformar esta materia, ampliando la previsión que de la misma realizaba nuestra Lecrim. La escueta y casi inexistente regulación anterior, ha sido sustituida por un sinfín de artículos cuyo análisis, cuanto menos a priori resulta de difícil comprensión y análisis. Con esta reforma, el legislador ha pretendido dar cobertura legal al régimen de la intervención de las comunicaciones, aportando así cuanto menos mayor seguridad jurídica.
