Abstract

El presente trabajo consiste en el análisis, revisión y valoración de la normativa en materia de la Ley Orgánica 1/2015, de 30 de marzo, del cogido penal y de la Ley Orgánica 4/2015, de 30 de marzo, sobre la seguridad ciudadana, y en particular en el análisis de los delitos de atentado y de desorden público establecidos en el código penal. Con todo ello se pretende ofrecer una visión clara y sistemática de todas las modificaciones que han afectado al objeto de estudio, especificando los aspectos tanto positivos como negativos de las reformas que afectan de manera directa a la seguridad ciudadana. En primer lugar se analiza de manera general las reformas de la ley de seguridad ciudadana, así como las infracciones y sanciones, distinguiendo entre conductas que se tipifican como muy graves, graves o leves dependiendo de daño causado. Además de las posturas a favor o las críticas que ha originado esta ley. En segundo lugar se analiza de forma más específica los delitos de atentado y de desorden público recogidas en el código penal, y las consecuencias que estos conllevan. Así mismo se acentúan las nuevas incorporaciones y las modificaciones realizadas. Por último el delito forma parte de la sociedad aunque el objetivo del Estado debe de de reducirla lo máximo posible mediante políticas correctas.

The present work consists in the analysis, revision and evaluation of the regulations in matters of the Organic Law 1/2015, of March 30, of the penal code and the Organic Law 4/2015, of March 30, about public security, and in particular the analysis of the crimes of assault and public disorder established in the penal code. With all this, the aim is to present a clear and systematic vision of all the modifications that have affected the object of the study, specifying both the positive and negative aspects of the reforms that directly affect public security. First, a general analysis is completed of the reforms of the law of public security as well as the offences and sanctions, distinguishing between acts that are classified as very serious, serious and minor depending on the damage caused, as well as the positions in favour and criticisms stemming from this law. Secondly, the felonies of assault and public disorder of the penal code and the consequences that they cause are more specifically analysed, with emphasis on the new incorporations and modifications carried out. Lastly, crime is part of society, although the objective of the State should be to reduce it as much as possible with effective policies.
