La custodia compartida

Abstract

El objeto de este trabajo es el estudio de uno de los regímenes de distribución de guarda y custodia de los menores en los supuestos de crisis entre los progenitores que conlleve a la ruptura de la convivencia. Analizaremos la guarda y custodia compartida entre los progenitores de los menores en contraposición con el régimen de custodia monoparetal, resaltando los principios que presiden al primero de estos sistemas de convivencia. Observaremos las diversas formas de custodia compartida existentes, haciendo referencia al reparto del tiempo de convivencia, que influirá sobre las mismas. Además, veremos la evolución históricojurídica que da lugar a la introducción legal de esta figura, por primera vez en el Ordenamiento Jurídico español, con la Ley 15/2005. Asimismo, se procede a un análisis comparativo sobre las diferentes regulaciones que se llevan a cabo de esta materia en la legislación civil foral de aquellas Comunidades Autónomas que tienen competencia sobre esta cuestión, a saber: Aragón, Cataluña, Navarra y Comunidad Valenciana.
