Aspectos jurídicos de la violencia de género entre menores

Abstract

La violencia de género es una lacra social tan vieja como la humanidad. Sin embargo en la sociedad actual parece estar normalizada. Somos conscientes de la extensión que ha cobrado este delito dando lugar a víctimas con perfil muy variado. Es indiferente la clase social, el nivel educativo, el origen e incluso la edad. Todas las mujeres podemos sufrir en cualquier momento de nuestra vida este delito. Existen diversas teorías en torno a las causas del maltrato hacia la mujer, pero una de las más acertadas es la creencia de que todavía en el siglo XXI existe una sociedad patriarcal que atribuye estereotipos distintos a cada género. La mujer ha sido educada para ser sumisa y estar sometida al hombre, dado que según la sociedad patriarcal posee características concretas que la responsabilizan del cuidado de su marido, sus hijos, las tareas domésticas… Su destino es casarse y formar una familia, de lo contrario podría ser considerada como una fracasada. En cambio el hombre asume el rol de dominante y cree estar en una posición superior a su mujer. El maltrato puede ser de varios tipos: psicológico, económico, físico y sexual. Inicialmente las agresiones no son físicas, sino que normalmente empiezan con pequeños incidentes de maltrato psicológico y la víctima (sobretodo si es menor de edad) puede tener cierta dificultades para detectar esas acciones como ofensivas. Las consecuencias de esta violencia son de extrema gravedad tanto física como psíquicamente. Además, si tenemos en cuenta el hecho de que la víctima sea menor, las repercusiones pueden ser peores dada la escasa madurez de éstas y la falta de desarrollo cognitivo para asimilar la situación. Por ello, para erradicarla es primordial la prevención desde las bases educativas que permitan enseñar a los menores qué comportamientos son violencia y cuáles no lo son. No debemos olvidar que los menores aprenden lo que los adultos les enseñan.

Gender violence is a several problem in society. However, nowadays society seems to normalize this crime. We are aware of the extent that this crime has claimed victims resulting in varied profile. It is indifferent social class, educational level, origin and even age. All women can suffer at any time of our life this crime. There are several theories about the causes of abuse against women, but one of the most successful is currently we live in patriarchal society that different stereotypes attributed to each gender. The woman has been raised to be submissive and be subject to man, since according to the patriarchal society has specific features that the responsibility of caring for her husband, her children, housework ... Their fate is to marry and raise a family, what otherwise it could be considered a failure. Instead the man assumes the role of dominant and believed to be in a position superior to his wife. Abuse can be of several types: psychological, economic, physical and sexual. Initially the attacks are not physical, but usually start with small incidents of psychological abuse and the victim (especially if it is a minor) may have some difficulty detecting such actions as offensive. The consequences of this violence are extremely serious both physically and psychically. Moreover, if we consider the fact that the victim is a minor, the impact may be worse given the low maturity of these and the lack of cognitive development to assimilate the situation. Therefore, it is essential to eradicate prevention from the educational foundations to teach children what behaviors are violence and which ones are not. We must not forget that children learn what adults teach them.
