Abstract

El Tribunal de Justicia de las Comunidades Europeas, a través del planteamiento de cuestiones prejudiciales en dos asuntos conexos, interpreta el principio de no discriminación que se establece en el Acuerdo Marco, que figura como anexo en la Directiva 99/70/CE de 28 de junio de 1999, sobre el trabajo de duración determinada. Declara su aplicación a los funcionarios interinos así como la obligación de reconocer el derecho al complemento por antigüedad con efectos retroactivos, por considerar que no puede justificarse la diferencia de trato, en la atribución de un complemento salarial por antigüedad, solamente por la naturaleza temporal de la relación de servicio de los empleados públicos.

The Court of Justice of the European Community through the approach of preliminary rulings in two related cases, interpreted the principle of non discrimination set out in the Framework Agreement annexed to Directive 99/70/EC of 28 June 1999 on fixed-term employment. Declares its application to temporary staff and obligation to recognize the right to add retroactive seniority, on the grounds that no justification for differential treatment in the allocation of a salary bonus for seniority only by the temporary nature service ratio of public employees.
