Abstract

The receptive attitude which allows us to overcome the technical problem caused by the lack of juridical binding value of the Charter. Case Law uses the Charter an interpretative parameter.Close to some classical rights, new generation rights declared in the Charter are the ones which give more help to the legislative power

España supera el problema técnico de que la Carta de Derechos Fundamentales no sea vinculante. Así, la jurisprudencia recurre a la Carta como parámetro interpretativo. Junto a algunos derechos clásicos, son los derechos de nueva generación proclamados en la Carta los que prestan mayor ayuda a la función judicial
