Riesgo permitido y principio de legalidad: la remisión a los estándares sociales de conducta en la construcción de la norma jurídico-penal

Abstract

La categoría de riesgo permitido constituye un primer filtro esencial en la construcción de toda norma de conducta penal, pues aquellas conductas abarcadas por el riesgo permitido se han de descartar como posibles injustos penales. En estas líneas se analizan las implicaciones que el riesgo permitido tiene para el principio de legalidad, pues en la medida en que aquel supone una remisión a estándares de conducta socialmente vigentes, conduce a una relativización del alcance de principio de legalidad. Tras analizar el fenómeno de la remisión a los estándares sociales de conducta, se aborda el problema del contenido del riesgo permitido, para lo que se someten a crítica los diversos criterios de construcción que la doctrina ha formulado al respecto y se cierra con una propuesta de solución.
