El acceso del arrendamiento al Registro de la Propiedad es una cuestión controvertida que ha generado tanto un histórico interés doctrinal como un actual interés político y social por la relación que mantiene con el derecho al acceso a la vivienda subsumible al artículo 47 de la CE. La doctrina ha discutido frecuentemente sobre la posibilidad técnica del acceso del arrendamiento al Registro, sobre todo por la falta de unidad en relación con la naturaleza real o personal de este derecho. No obstante, la nomenclatura otorgada a la naturaleza del arrendamiento es irrelevante teniendo en cuenta que con su inscripción produce efectos reales. Estos efectos despliegan una serie de implicaciones, entre las que se encuentra la protección del arrendatario en un plano adicional al que proporciona la LAU. No obstante, el despliegue logístico que supone inscribir el arrendamiento en adición a los costes a sufragar disuade la inscripción del arrendamiento. Tanto, que ni siquiera el IRAI refleja este tipo de transacciones. Esto es debido a que al arrendador no le conviene la inscripción, ya que le supone más inconvenientes que ventajas; al arrendatario no le compensa debido a la extensa protección que ya le otorga la LAU; y el Estado, aunque sustente un interés legítimo en la inscripción, no está legitimado para proceder a ella, puesto que no es parte en el contrato de arrendamiento.
The access of the lease to the Property Registry is a controversial issue that has generated both doctrinal and sociopolitical interests due to its relationship with the Right to Housing contained in article 47 of the Spanish Constitution. The doctrine has frequently discussed the technical possibility about the access of the lease to the Registry, especially due to the lack of unity in relation to the nature of this right. However, the nomenclature given to the nature of the lease is irrelevant considering that its registration produces in rem effects. These effects unfold a series of implications, among which is the protection of the tenant that is also provided on by the Spanish Lease Act (LAU). Nevertheless, the logistical deployment involved in registering the lease in addition to the costs to be borne, deters the registration of the lease. So much so, that not even the IRAI reflects this type of transactions. This is because registration is not convenient for the landlord, since it causes more inconveniences than advantages. In addition, the tenant is not interested in the registration due to the extensive protection already granted by the LAU. Finally, the State, although it maintains a legitimate interest in the registration, is not entitled to proceed with it, since it is not a party in the lease contract.
