Determinismo y culpabilidad penal: el libre albedrío ante los avances en neurociencia

Abstract

El determinismo es una doctrina filosófica que defiende la inexistencia del libre albedrío en el ser humano debido a factores con los que contamos que, como su nombre indica, determinan nuestros actos, y por ello niega la existencia de la libertad. Esta idea ha ganado peso a medida que la ciencia ha tomado protagonismo en el debate mediante sus avances en el campo de las neurociencias, los cuales tienden a defender un determinismo materialista que ha puesto en entredicho la existencia de la libertad y, con ello, la articulación del principio de culpabilidad penal y la legitimación de las razones que motivan la articulación e imposición de penas. Pero la cuestión va más allá, ya que la afirmación del determinismo parece también amenazar la forma en la que funciona la sociedad y nuestras interacciones dentro de ella, por lo que el debate debe centrarse también en las consecuencias que tiene el determinismo o, por el contrario, la afirmación de la libertad, así como en la posibilidad o imposibilidad de abordar la cuestión de forma generalizada y empírica.
