El blanqueo de capitales con criptoactivos: una aproximación a los nuevos métodos de blanqueo

Abstract

El delito de blanqueo de capitales es una figura delictiva de creación relativamente nueva, cuyo origen se sitúa en la década de los años sesenta en los Estados Unidos de América. Con todo, se trata de uno de los tipos penales sujetos a mayor renovación y modificación, habida cuenta de los nuevos métodos de criminalidad que surgen para eludirla. Este trabajo tiene por objeto uno de ellos: el uso de las nuevas tecnologías blockchain en la ejecución del delito de blanqueo de capitales y, más específicamente, en cómo los criptoactivos pueden beneficiar y aportar ventajas a los esquemas de blanqueo de capitales.

Money laundering is a crime of relatively new creation, whose origin is located in the decade of the sixties in the United States of America. However, it is one of the criminal offences subject to greater renewal and modification, given the new methods of criminality that arise to avoid it. This work aims at one of them: the use of new blockchain technologies in the execution of the crime of money laundering and, more specifically, how crypto-assets can benefit and bring advantages to money laundering schemes.
