La protección de la vivienda en el CEDH: un análisis a las obligaciones positivas derivadas de la jurisprudencia del TEDH

Abstract

Resultado de las recientes crisis económicas, la pérdida de la vivienda familiar es un fenómeno constante en nuestra sociedad. El papel del CEDH en la protección de vivienda resulta de gran relevancia para esta, aunque, prima facie, no existen obligaciones para los Estados establecidas en el Convenio. El objeto de este trabajo es determinar si a lo largo de la jurisprudencia del TEDH se han establecido obligaciones positivas para los Estados en materia de vivienda. Para ello, una vez delimitado el concepto de obligación positiva, se ha realizado un análisis de la jurisprudencia del Tribunal de Estrasburgo. En esta se identifican una serie de obligaciones positivas, divididas en procedimentales y de fondo, que marcan la actuación del estado relativo la protección del individuo frente a la pérdida de la vivienda. Si bien son consideradas obligaciones de mínimos, será la tarea del legislador nacional ampliar estas, limitándose el rol del tribunal en la protección del mínimo exigible al estado.

As a result of the recent economic crisis, the loss of a home has become a prevalent issue in our society. The role of the ECHR is significant in the prevention of it, even though prima facie there are no obligations towards the states in the Convention. The object of this work is to demonstrate whether positive obligations have been established towards states in the jurisprudence of the TEDH regarding the protection of homes. To achieve this, first, the concept of positive obligation is defined, followed by an analysis of Strasbourg’s Tribunal jurisprudence. As a result, a series of positive obligations were identified and divided between judicial proceedings and substantive ones, which define the state’s framework for protecting individuals who suffer the loss of a home. These obligations are considered minimum, and it is the task of the national legislator to expand them, thereby limiting the tribunal’s role in protecting the minimum claimable at the state.
