La sujeción al derecho internacional humanitario por grupos armados en conflictos armados no internacionales: cómo hacer atractivo el cumplimiento del DIH

Abstract

En la actualidad, la mayoría de los conflictos armados son de carácter no internacional. Esta realidad contrasta con que históricamente el foco de interés se ha dirigido a los conflictos armados internacionales, y, debido a esto, reciben una mayor protección. Esta tesis acoge la regulación del Derecho Internacional Humanitario (DIH), especialmente el Artículo 3 Común a los Convenios de Ginebra y el Protocolo Adicional Segundo, y la combina con la doctrina y la jurisprudencia de tribunales internacionales para abordar la aplicabilidad del DIH a los grupos armados en conflictos armados internos. Más adelante se pretende distinguir un problema académico: la aplicabilidad del DIH a los grupos armados; de un problema práctico: la capacidad real de los grupos armados de respetar normas del DIH sin necesariamente perder la guerra. Se pretende hacer frente a una tendencia de incumplimiento del DIH generalizado, entendiendo que las normas deben ser más realistas, y el DIH más atractivo. Finalmente, como uno de los objetivos, se contempla contribuir a la teoría establecida enmarcando la tesis desde una perspectiva práctica, utilizando como referente al conflicto sirio, que, por numerosas razones, como la segregación del conflicto y su grave atrocidad, ostenta gran interés práctico.

Nowadays, the vast majorities of armed conflicts are of a non-international character. This reality collides with the traditional practice of focusing on international armed conflicts, which, due to this reason, hold greater protection. This thesis analyses IHL regulation, particularly, Common Article 3 to the Geneva Conventions, and Additional Protocol II, and combines it with the doctrine and the international tribunals’ jurisprudence, to approach the applicability of IHL to armed groups in non-international armed conflicts. Additionally, it seeks to distinguish an academic issue: IHL applicability to armed groups, from a practical complexity: the actual capacity of armed groups to respect IHL norms without necessarily losing the war. It attempts to tackle the current trend of widespread IHL incompliance, understanding that norms should be more realistic, and IHL more attractive. Finally, one of the objectives is to contribute to the established theory by framing the thesis from a practical perspective, using the Syrian war as a reference, due to numerous reasons, such as the conflict’s segregation, and mass casualties.
