Análisis de la ley de transparencia en España y estudio de la transparencia de las comunidades autónomas en 2014

Abstract

Este trabajo trata de presentar la Ley de Transparencia y analizar los efectos producidos tras su aprobación en el país para así, determinar las carencias que presenta y detallar las propuestas de mejora que harían del texto legal el más completo y con mejores resultados de la Unión Europea. Se toma en consideración, para ello, la situación de España en la Unión Europea y las recomendaciones que emanan de órganos supranacionales, así como de organizaciones encargadas de promover la transparencia del Sector Público. Además de ello, se para atención al grado de transparencia de las Comunidades Autónomas en el año 2014 estableciendo una relación de las autonomías que más cambio hacia la transparencia han logrado y analizando los motivos o factores a los que se debe la magnitud del mismo. En definitiva, se trata de un estudio completo que condensa toda la información relativa a la transparencia en España e incide, como caso de estudio, en las Comunidades Autónomas ofreciendo al lector una visión crítica con propuestas ideadas bajo los lentes de un politólogo y jurista interesado por la calidad democrática y la rendición de cuentas

This paper attempts to present the Transparency Act and analyse the effects after its approval so as to identify possible scarcities and detail some proposals for improvements that would make this legal text the most complete and best performing of the European Union. In order to do so, it is going to be taken into consideration the situation of Spain in the European Union and the recommendations emanating from supranational bodies and organizations in charge of promoting transparency in the public sector. Furthermore, this project will focus on the degree of transparency of the autonomous communities in 2014 by establishing a relationship between the communities that changed more towards transparency and analysing the reasons or factors that contributed to this huge change. In short, it is a study that condenses all the information concerning transparency in Spain and focuses on the autonomous communities by offering the reader a critical vision with proposals devised under the lens of a political scientist and jurist interested in democratic quality and accountability.
