RESUMEN El documento de voluntades anticipadas es una consecuencia directa del principio de autonomía reconocido al paciente que han de cumplirse cuando llegue el momento en que éste ya no pueda tomar decisiones. Se encuentra recogido en la Ley 41/2002 básica reguladora de la autonomía del paciente y de derechos y obligaciones en materia de información y documentación clínica, de 14 de noviembre, y también por distintas normas autonómicas. Cualquier persona capaz, mayor de edad y libre puede otorgar el documento de instrucciones previas formalizándolo: bien ante notario; ante tres testigos o por medio de funcionario encargado del Registro de Instrucciones Previas. A pesar de suscitar un gran interés entre los ciudadanos cuando lo conocen, actualmente es un documento de escasa incidencia práctica por lo que se precisa de una mayor difusión y compromiso de los profesionales de la sanidad para que sea una herramienta que contribuya a conocer y respetar la voluntad del paciente.ABSTRACT The advance health care directive document is a direct consequence from the principle of autonomy which shall be carried out in the moment when the patient is not longer able to make decisions. It is regulated by the Act 41/2002 on the patient's autonomy and the rights and duties in terms of clinical information and documentation, of 14th November. Any person of legal age, in full possession of his/her faculties and free of duress or undue influence can have the document of previous instructions available. For that purpose it is necessary to formalize the document before a notary; three witnesses or before a civil servant responsible for the Registry of Previous Instructions. Despite this document arouses a great interest among the citizens when they get to know about it, nowadays it is a document with a limited practical effect. Therefore, a better dissemination and the commitment from the healthcare professionals are necessary to improve the situation and awareness of this document.
