This paper studies the new article 27 of the Spanish Insolvency Act, as well as its perfection in the Royal Decree of 23 February 2015 draft. Based on these regulation two aspects are analyzed: on the one hand, the subjective conditions for the appointment of the insolvency administrators which is pretended to be introduced by the new regulation, that is: requirements for tenure, system access, training and skills required and selection model designed; and on the other hand the chances of appointment of legal persons as insolvency administrators, after the demanding requirements established by the new regulation, mainly according to its composition, in the above draft regulation examined.
En el presente trabajo se aborda el estudio del nuevo art. 27 LC y su perfección en el proyecto de Real Decreto de 23 de febrero de 2015. Sobre dicha base normativa, se analizan, de un lado, aquellos extremos que respecto a las condiciones subjetivas para el nombramiento de administradores concursales se pretenden implantar, así: requisitos para el ejercicio del cargo, sistema de acceso, formación y destreza exigible y modelo de selección diseñado; de otro, se examinan las posibilidades de designación de las personas jurídicas como administradores concursales tras los exigentes requisitos establecidos, fundamentalmente en su composición, en el antedicho proyecto de reglamento.
