La entrada en vigor de la Ley 39/2015 en el ámbito de las Administraciones Públicas y de la Ley 42/2015 en el ámbito de la Administración de Justicia han venido a modificar de forma radical el modo en que hasta este momento se realizaban las notificaciones a interesados y justiciables respectivamente. La imposición legal de la obligatoriedad para muchos sujetos –tanto personas físicas, como jurídicas, como entes sin personalidad jurídica– de relacionarse exclusivamente por medios electrónicos ha provocado situaciones que afectan de modo decisivo en la esfera de sus derechos, perjudicando de forma ostensible incluso alguno de los protegidos constitucionalmente. La actuación conforme a la Ley puede ser legal, pero no por ello justa, y en ningún caso exenta de provocar incluso indefensión.

The entry into force of Act 39/2015 related to the modernization of Public Administration and Act 42/2015 in the field of the Administration of Justice have come to radically change the way notifications have been made up to now. The legal obligation for many subjects –both natural and corporate persons- to communicate by electronics means in the field of judicial proceedings has lead to situations that affect their rights, particularly some of them that are protected by the Constitution. Although this interpretation may respect the above-mentioned legal framework it is not fair from the Constitutional perspective since it may affect the right to due process and even imply denial of the means for defense.
