El presente artículo aborda de una manera crítica, objetiva y extensiva el Real Decreto Legislativo 1/2007, y en concreto su libro tercero en lo que se refiere a la responsabilidad por productos defectuosos. Se ha intentado dar respuesta a múltiples cuestiones referentes a esta materia, destacando, en primer lugar, la forma legislativa utilizada para la introducción de esta regulación, así como la propia regulación, siendo de gran importancia el análisis de las distintas figuras que se pueden encuadrar en la institución de productor, así como la forma en la que responden cada uno de ellos. Además, también se trata de manera crítica la figura del proveedor (antiguo suministrador) y el tratamiento de su responsabilidad. No debiendo finalizar este sin un apartado referido a la figura del “tercero”, y como se incardina este en el entramado de la responsabilidad por productos defectuosos. Todo ello llevado a cabo con un tratamiento exhaustivo de la doctrina y de la jurisprudencia más destacada de los últimos años tanto a nivel de Audiencia Provinciales como del Tribunal Supremo.

The present article approaches in a critical, objective and extensive way the Royal Decree 1/2007, and particularly its third book referred to the liability of defective products. Attemps have been made in order to find answers to many issues related to this subject, highlighting the legislative form used for the introduction of this regulation and the regulation itself. It has been considered so important the analysis of different figures which can be came under the producer institution, as well as the way in which each of them responds. In addition, the need to criticize the figure of the provider (old supplier) and the treatment of his responsibility has also been worthy in this work. It should not end without a section referring to the figure of the “third party” and how it is included in the framework of liability of defective products. Everything has been carried out with an exhaustive treatment of the most outstanding doctrine and jurisprudence (both in Provincial Court level and in Supreme Court level).
