Member States follow different trends to determine the law applicable to the celebration of marriage. In this paper these trends are studied from the viewpoint of their compatibility with European law. This analysis starts from the principle of freedom of movement. In particular, the article argues that the accordance with European standards would be guaranteed if a common to all Member States conflict-of-laws provision allowed future spouses to choose the law applicable to their capacity and their consent to marry, and if, in absence of agreement, such provision contemplated the application of the personal law of each spouse.
En los Estados Miembros existen tendencias encontradas a la hora de determinar la Ley aplicable a la celebración del matrimonio. En este trabajo se estudian esas tendencias desde el punto de vista de su compatibilidad con las libertades europeas. En particular, en el artículo se defiende que la concordancia con las normas europeas quedaría garantizada si existiera una norma de conflicto común a todos los Estados Miembros que permitiera a los futuros contrayentes elegir la Ley aplicable a su capacidad y consentimiento matrimonial, y que en defecto de pacto contemplara la aplicación de la Ley personal de cada contrayente.
