The study analyses the conception of press freedom in the Spanish liberalism («doceañista», moderate, progresist and democrat), on the basis of a survey about the characteristics of the modern censorship (in civil and inquisitorial manifestation) in order to understand the limited nature as a right (the civil and constitutional right which is subject to the law, resistant against the influx of the rationalistic natural law), as well as the keys of a legal and jurisdictional regulatory treatment from which it is gathered a strong inclination towards the anticipation and repression of his pathology: the abuse, as a less technical constant expression, and in the end the press crime, that range between his classification as special offence and the engagement to the common maximun of the criminal code and the court’s jurisdiction.
El trabajo analiza la concepción de la libertad de imprenta en el liberalismo español (doceañista, moderado, progresista y demócrata), partiendo de un estudio de las características de la censura moderna (en su manifestación civil e inquisitorial) para la comprensión de su naturaleza limitada como derecho (derecho civil constitu cional y sujeto a la ley, resistente contra el influjo del iusnaturalismo racionalista), así como de las claves de un tratamiento normativo legal y jurisdiccional del que se deduce una marcada inclinación hacia la previsión y represión de su patología: el abuso, como expresión constante menos técnica, y en definitiva el delito de imprenta, que oscila entre su tipificación como delito especial y la sujeción al límite común del código penal y la unidad de fuero.
