Intervención con menores infractores: su evolución en España

Abstract

El presente trabajo intenta ofrecer una panorámica general sobre la evolución de la intervención con el menor infractor en España. Se analizan las características básicas del Modelo Tutelar, base para la Ley de Tribunales Tutelares de Menores de 1948, vigente en España hasta la promulgación de la actual Ley de 5 de Junio de 1992, fundamentada en la filosofía del Modelo de Justicia. Se exponen detalladamente cada una de las posibles medidas a adoptar en la actualidad en la Justicia de Menores: amonestación, breve internamiento, libertad vigilada, acogimiento familiar, privación del derecho a conducir, prestación de servicios en beneficio de la comunidad, tratamiento ambulatorio e internamiento en centro de régimen abierto, semiabierto o cerrado. Se propone, así mismo, la reparación extrajudicial como alternativa de intervención en medio abierto y por último se hace una breve reseña de las tendencias legislativas actuales en materia de menores en España.
