Publicidade e direitos do consumidor

Abstract

A publicidade assume um papel determinante nas escolhas e decisões dos consumidores. Para além da dimensão concorrencial de diferenciação das empresas no mercado, e da vertente cultural na definição de estilos de vida e comportamentos sociais, é através da publicidade que se faz o primeiro contacto dos consumidores com os bens e serviços que pretendem adquirir. “Na prática, os bens são ‘pré-comprados’ através da publicidade”1 , o que só por si justifica uma reflexão em torno da relevância jurídica da publicidade nas relações de consumo. Pretendemos na presente lição abordar a temática da publicidade em articulação com a proteção do consumidor, com ênfase nos direitos do consumidor à informação, à qualidade dos bens e serviços de consumo e à proteção dos interesses económicos. Depois de algumas considerações genéricas sobre o regime jurídico da publicidade e os direitos do consumidor, iremos centrar-nos na função informativa da publicidade e na forma como tais informações se integram no contrato de consumo e constituem critério de conformidade contratual e de lealdade da prática comercial da empresa na sua relação com o consumidor.
