Os métodos tradicionais para solução de conflitos tornaram-se inaptos frente aos novos conflitos e a configurações sociais de direitos e interesses jurídicos que extrapolam a esfera individual. O direito concorrencial, por sua vez, revela um caráter transindividual, exigindo que o processo deixe de ser uma controvérsia entre particulares, passando a representar direitos pertencentes ao grupo, ao público em geral ou a um determinado segmento social. A substituição processual dos legitimados ativos ao pedido de indenização por danos concorrenciais permite que os particulares sejam representados judicialmente na defesa de direitos transindividuais ou individuais homogêneos. A coisa julgada vinculativa a todos os membros do grupo tem especial relevância no sistema

Traditional methods for conflict resolution have become unfit for new conflicts and social configurations of rights and legal interests that go beyond the individual sphere. Competition law, on the other hand, reveals a transindividual character, requiring that the process cease to be a controversy between individuals, and to represent rights belonging to the group, the public in general or a certain social segment. The procedural substitution of legitimized citizen to claim for compensation for competitive damages allows individuals to be represented in court in the defense of transindividual or homogeneous individual rights. The judgement binding on all members of the group has special relevance in the system.
