Abstract

O presente ensaio visa a discutir a relação existente entre a natureza jurídica diferenciada do Direito do Trabalho no âmbito coletivo e a aplicação e/ou a criação de Direito objetivo, e não somente a concretização de direitos subjetivos, nos casos de julgamento de demandas envolvendo direitos coletivos trabalhistas, uma vez que as sentenças normativas produzem coisa julgada com eficácia erga omnes, pois os seus limites subjetivos estendem-se aos integrantes das categorias que figuraram como parte na demanda coletiva, independentemente de serem sócios (associados, filiados) do sindicato. Trata-se de uma importante alternativa de solução para a crise da generalidade e da abstração das leis e para uma maior efetividade do processo do trabalho, que deve avançar, considerando-se que mais importante do que assegurar o direito de ação é assegurar ao maior número possível, mesmo aos que não propuseram ação, o gozo de seus direitos, mediante aplicação do Direito objetivo.
