Aspectos bioéticos e jurídicos do transexualismo

Abstract

O transexualismo tem sido muito discutido atualmente, tanto na área médica como jurídica. Diferentes aspectos relativos à readequação sexual dos portadores de transexualismo estão envolvidos nesta discussão, enfatizando-se, sobretudo, o direito à identidade sexual, que é um direito fundamental. Em 1997, o Conselho Federal de Medicina editou uma Resolução que estabelece critérios diagnósticos de transexualismo e critérios para a realização da cirurgia de transgenitalização. A cirurgia é uma das etapas do processo de readequação sexual.

Currently, transsexualism is a widely discussed matter in both the fields of medicine and law. This discussion involves different aspects related to the sexual readaptation of carriers of transsexualism, with special emphasis on the right to sexual identity, which is a fundamental right. In 1997, the Federal Council of Medicine of Brazil passed a resolution establishing diagnostic criteria for transsexualism and for the carrying out of surgery for sex reassignment. The surgery is one of the steps of the process of sexual readaptation.
