Prórroga forzosa convencional en arrendamiento celebrado bajo la LAU-1994 con arrendatario persona física

Abstract

El Supremo aborda su primera sentencia sobre arrendamiento de local nacido bajo la LAU-1994 con prórroga forzosa con arrendatario persona física, y lo hace integrando el contrato e imponiendo un tope inspirado en el criterio básico de la DT 3ª.3 LAU-1994 con muchas adaptaciones (el contrato vale hasta la jubilación o fallecimiento de la última de las arrendatarias, sin derechos de subrogación), lo que puede considerarse una respuesta satisfactoria para el caso. Una sentencia que continúa la tendencia del Supremo (muy de agradecer) a unificar y racionalizar su doctrina sobre prórroga forzosa convencional.
