Caso Castillo Paez - Corte Interamericana de Derechos Humanos

Abstract

Este caso fue sometido a la Corte Interamericana de Derechos Humanos (en adelante "la Corte" o "la Corte Interamericana") por la Comisión Interamericana de Derechos Humanos (en adelante "la Comisión" o "la Comisión Interamericana") mediante escrito de 12 de enero de 1995, recibido el día siguiente en la Secretaría de la Corte (en adelante "la Secretaría"). Se originó en una denuncia (Nº 10.733) contra Perú recibida en la Secretaría de la Comisión el 16 de noviembre de 1990. 2. Al presentar el caso ante la Corte, la Comisión invocó los artículos 50 y 51 de la Convención Americana sobre Derechos Humanos (en adelante "la Convención" o "la Convención Americana") y los artículos 26 y siguientes del Reglamento. La Comisión sometió este caso para que la Corte decidiera si hubo violación, por parte del Gobierno, de los siguientes artículos de la Convención: 7 (Derecho a la Libertad Personal), 5 (Derecho a la Integridad Personal), 4 (Derecho a la Vida), 8 (Garantías Judiciales) y 25 (Protección Judicial), todos ellos en concordancia con el artículo 1.1 (Obligación de Respetar los Derechos) de la misma Convención, por el supuesto "secuestro y posterior desaparición de Ernesto Rafael Castillo Páez por parte de la Policía Nacional del Perú en violación de la Convención ".
