Abstract

Publicity is a guarantee of independence and impartiality of Administration of Justice. This aim of transparency justifies the court’s reports in Media. But even if the Media assumes this kind of report as a control over judicial activities, their priority is always to offer the news to the public. There are tree main subjects in the study. First, the continuity or non-continuity between the judicial publicity and the Media publicity; second, the conflict between the secret of judicial brief and the right to know; and third, the risk of parallel process in Media. The analysis is completed with a reference of comparative law in cameras in courtrooms, with a special emphasis to American law, nowadays in a permissive frontline. La publicidad es una garantía de independencia e imparcialidad en la administración de justicia. Este objetivo de transparencia justifica las crónicas de tribunales en los medios de comunicación. Pero aún admitiendo que los medios asumen que este tipo de cobertura periodística cumple una función de control sobre el poder judicial, su prioridad siempre es la de informar al público sobre la actualidad. El estudio se centra en tres cuestiones: la continuidad o no continuidad entre la publicidad judicial y la publicidad de los medios de comunicación; el conflicto entre el secreto de sumario y el derecho a la información; y el riesgo de los juicios paralelos. El análisis se completa con una referencia de derecho comparado acerca del acceso de las cámaras a las salas de juicios, prestando especial atención al derecho estadounidense, hoy en la vanguardia de una regulación permisiva en la materia
