Abstract

La creciente complejidad de las decisiones que han de adoptarse en el tráfico jurídico conlleva que quienes tienen la competencia para adoptarlas deban apoyarse en el criterio de los asesores técnicos. Ello plantea relevantes problemas de atribución de responsabilidad en el ámbito de los delitos especiales, por cuanto en muchas ocasiones el intraneus adoptará su decisión sin conocimiento de su ilegalidad , confiando en el criterio del asesor técnico (extraneus) y, con las reglas generales de imputación, no podrá hacerse responsable ni al intraneus —por falta de dolo—, ni al extraneus — porque la participación en el delito presupone una conducta típica de autoría. En el trabajo se analizan las propuestas de la jurisprudencia del Tribunal Supremo para intentar hacer frente a dicha laguna de punibilidad, proyectando en análisis sobre el delito fiscal y la prevaricación.
