Abstract

Partiendo de la situación de gran preocupación por la saturación de asuntos en materia tributaria de nuestros Tribunales administrativos y jurisdiccionales, en el original se desgranan aquellos elementos que entendemos podrían coadyuvar a sentar unas bases sólidas para realizar avances firmes en las relaciones cooperativas entre la Administración y los contribuyentes (win -win), y se ilustran distintas situaciones actuales que no favorecen precisamente a ese ansiado “tente cordiale”, sino que por el contrario invitan por desgracia a la “fricción”, generando permanentemente litigiosidad. Para alimentar una futura relación de confianza recíproca se acompañan distintas propuestas de mejora cimentadas en los principios basilares de Nuestro Ordenamiento Jurídico como son el de proporcionalidad, seguridad jurídica, el de buena fe y la buena Administración Pública

En el citado trabajo se realiza un análisis minucioso de cuál es la causa del exceso de litigiosidad que existe en nuestro sistema tributario apuntando por una serie de medidas para combatir la judicialidad, medidas que gravitan no solo por evitar el conflicto, sino también una vez que se ha iniciado, establecer distintas medidas a través de formulas ADR (alternative dispute resolutions) para su ágil resolución
