Abstract

A pesar de que en las últimas décadas formalmente se ha alcanzado un nivel importante de igualdad entre mujeres y hombres con la existencia de numerosas leyes, documentos internacionales, normativa comunitaria y pronunciamientos de tribunales estatales y supraestatales, todavía queda mucho por hacer en la consecución de una real y efectiva igualdad material. Se puede afirmar, de este modo, que tanto la igualdad de género como el empoderamiento de las mujeres siguen estancados debido a la persistencia de desigualdades históricas y estructurales en las relaciones de poder entre mujeres y hombres lo que afecta especialmente a la autonomía económica. Asimismo, las situaciones de pobreza aumentan dichas desigualdades y desventajas afectando negativamente al acceso a recursos y oportunidades para las mujeres. Los poderes públicos, además, parecen desconocer estas desigualdades históricas y estructurales de forma que a menudo aprueban medidas de apoyo al sector laboral o al sector empresarial que siguen manteniendo una mirada muy sesgada en cuanto a los roles y al lugar que hombres y mujeres ocupan en la economía y en la sociedad. Una prueba de ello fue la Ley 14/2013, de 27 de septiembre, de apoyo a los emprendedores y su internacionalización aprobada en España en la que el legislador soslayó la transversalidad de las políticas públicas, contraviniendo lo establecido en el artículo 15 de la Ley Orgánica 3/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres. Posteriormente, algo se ha incorporado en la Ley 28/2022, de 21 de diciembre, de fomento del ecosistema de las empresas emergentes si bien, en nuestra opinión, se trata de medidas a todas luces insuficientes
