Tutela versus curatela

Abstract

En este artículo, tras analizar la sentencia del Tribunal Supremo de 24 de junio de 2013, se advierte de la utilización instrumental de la “curatela” para dar respuesta a situaciones que deberían ser objeto de una “tutela”, por aplicación directa de la Convención de Nueva York, pese a que el ordenamiento jurídico español las regula como instituciones diferentes. Asimismo, se hacen propuestas de lege ferenda.
