Abstract

O branqueamento de capitais é um fenómeno de criminalidade económico-financeira amplamente discutido nas últimas décadas, que desafia a integridade e estabilidade dos sistemas financeiros globais. Com o aparecimento dos criptoativos, em especial das criptomoedas, esta prática adquiriu novas dimensões, exigindo uma maior vigilância por parte das autoridades competentes e o surgimento de novas abordagens regulatórias. O presente trabalho tem como objetivo explorar os desafios do branqueamento de capitais na era das criptomoedas, com foco particular no quadro legal português e nas políticas europeias de prevenção. Através de uma análise às implicações da utilização de criptoativos na ocultação de fundos e ao papel das autoridades, nacionais e internacionais, este trabalho destaca as falhas do atual sistema de supervisão. Por conseguinte, procuramos investigar os métodos utilizados para “lavar” criptoativos provenientes de atividades ilícitas e analisar os mecanismos de prevenção existentes para combater essa prática. Mas a questão permanece: até que ponto é que as atuais políticas regulatórias estão preparadas para lidar com a velocidade das inovações tecnológicas?

Money laundering is an economic-financial crime phenomenon that has been widely discussed over de past decades, challenging the integrity and stability of global financial systems. With the emergence of crypto-assets, especially cryptocurrencies, this practice has taken on new dimensions, requiring greater vigilance on the part of the competent authorities and the emergence of new regulatory approaches. This paper aims to explore the challenges of money laundering in the cryptocurrency era, with a particular focus on the Portuguese legal framework and European prevention policies. Through an analysis of the implications of using crypto-assets to hide funds and the role of national and international authorities, this paper highlights the flaws in the current supervisory system. Therefore, we seek to investigate the methods used to "launder" crypto-assets from illicit activities and analyze the prevention mechanisms to combat this practice. But the question remains: to what extent are current regulatory policies prepared to deal with the speed of technological innovation?
