Este trabalho foi pensado e começou a ser elaborado em 2016. À época, ainda era recente o relatório publicado pela OCDE, no âmbito do projeto BEPS, que ditava as recomendações para o combate do problema da erosão da base tributável e transferência de lucros no âmbito internacional. Naquele ano, ainda havia uma série de incertezas em relação aos seus possíveis resultados e na sua implementação nos diversos Países. Dentre as 15 ações desenvolvidas pelo Projeto BEPS, a ação 12 inflamou um tema que vem sendo discutido há longa data pela comunidade jurídica: os conceitos globais adotados para impor limites à (ilegítima) elisão fiscal. Ao longo dos trabalhos da OCDE, a introdução ou a reintrodução do conceito da agressividade fiscal revelou a insegurança jurídica em torno do tema e despertou, em alguns Estados Soberanos, as vantagens arrecadatórias da implementação interna da Ação 12 do BEPS. Assim, em uma sociedade onde o consentimeno ao imposto é deficiente e os tributos são vistos como um custo na produção e geração de riqueza, os conceitos que gravitam o planeamento fiscal revelam a necessidade de um estudo permanente. Dessa forma, o objetivo do presente trabalho, partindo de uma premissa de que o planeamento fiscal sempre será submetido à uma acepção jurídica subjetiva, é estudar a figura do planeamento fiscal agressivo como forma de impor limites à autonomia privada e, ainda, sob o contexto dos demais conceitos e normas antielisivas. Será uma tendência global, tratar o planeamento fiscal como um direito nocivo ao sistema tributário?
This work began to be prepared in 2016. At the time, the report published by the OECD, as part of the BEPS project, was recent, dictating recommendations to combat the problem of tax base erosion and profit shifting at the international level. In that year, there were a number of uncertainties regarding its possible results and implementation in the various countries. Among the 15 actions developed by the BEPS Project, action 12 ignited a topic that has long been discussed by the legal community: the global concepts adopted to impose limits on (illegitimate) tax avoidance. Throughout the OECD's work, the reintroduction of the concept of tax aggressiveness revealed the legal uncertainty surrounding the topic and awakened, in some Sovereign States, the revenue-raising advantages of the internal implementation of BEPS Action 12. Thus, in a society where the consent to tax is deficient and taxes are seen as a cost in the production and generation of wealth, the concepts that gravitate to tax planning reveal the need for permanent study. Thus, the objective of this work, starting from the premise that tax planning will always be subject to a subjective legal meaning, is to study the figure of aggressive tax planning as a way to impose limits on private autonomy and, further, under the context of other concepts and anti-tax rules. Is it a global trend to treat tax planning as a right that is harmful to the tax system?
