Abstract

O teletrabalho é uma modalidade de prestação de trabalho que já se encontrava prevista no nosso Código do Trabalho. A chegada da pandemia Covid-19 obrigou as organizações a encontrar alternativas para manter as organizações no ativo, sendo uma destas o recurso ao teletrabalho. De uma forma genérica, entende-se como acidente de trabalho o que ocorra durante o tempo e no local de trabalho, que produza uma lesão corporal, perturbação funcional ou uma doença e que, por sua vez, se traduza num dano, ou seja, na diminuição da capacidade de trabalho, de ganho ou na morte. O legislador português preocupou-se em conferir ao trabalhador, vítima de acidente de trabalho, o direito à reparação pelos danos resultantes do infortúnio laboral. Deste modo, com a exigente adaptação laboral ao inesperado contexto pandémico, surgem alguns debates quanto à sua qualificação do ponto de vista conceptual. Partindo da realidade acima descrita, e demonstrando-se a pertinência do estudo, com esta dissertação pretende-se clarificar determinadas nuances que emergem do conceito de acidente de trabalho e nas causas de exclusão da responsabilidade do empregador, com consulta à reduzida doutrina nacional e às posições jurisprudenciais controversas. Para a realização deste estudo, teve-se por base uma pormenorizada e atenta leitura bibliográfica e documental, cuja consulta e recolha de informações foi concretizada tendo por base obras publicadas, revistas, publicações periódicas, artigos científicos, monografias, dissertações e palestras. Esta dissertação evidencia que ainda existe um longo caminho no sentido do desenvolvimento de um regime jurídico capaz de responder às necessidades do trabalhador.

Telework is a way of providing work that was already provided for in our Labor Code. The arrival of the Covid-19 pandemic forced organizations to find alternatives to keep them in business, one of these solutions was the beinging of the use of telework. Generally speaking, an accident at work is understood to be that which occurs during working hours and at the workplace, which produces a bodily injury, functional disorder or illness and which, in turn, results in an injury, i.e. a decrease in working, earning capacity or death. The Portuguese legislature was concerned with conferring upon the worker, the victim of an accident at work, the right to compensation for damages resulting from a work-related injury. Thus, with the demanding labor adaptation to the unexpected pandemic context, some debates arise as to its qualification from the conceptual point of view. Starting from the reality described above, and demonstrating the relevance of the study, this dissertation aims to clarify certain doubts that emerge from the concept of work accident and the causes of exclusion of employer liability, consulting the reduced national doctrine and controversial jurisprudential positions. In order to carry out this study, a detailed and attentive bibliographical and documental reading was made, whose consultation and collection of information was based on published works, magazines, periodicals, scientific articles, monographs, dissertations, and lectures. This dissertation shows that there is still a long way to go towards the development of a legal regime capable of responding to the worker's needs.
