Responsabilidade emergente de acidentes de trabalho

Abstract

Numa altura em que os Acidentes de Trabalho constituem uma das principais temáticas discutidas nos Tribunais do Trabalho Portugueses, urge determinar não só quais os eventos que no âmbito da vida profissional do trabalhador são susceptíveis de serem caracterizados como acidentes de trabalho, como também em que casos e em que medida, pode a entidade empregadora ser responsável pela sua reparação, ou em última análise “desresponsabilizada” e isentada do dever de reparação que a lei impõe. Não obstante o supra exposto, veremos que não deixa de ser curioso perante um tão vasto Código do Trabalho, que reúne um conjunto de mais de quinhentas normas reguladoras de situações jurídico-laborais, tenha o legislador preferido remeter todo o regime legal vigente para uma Lei avulsa, a qual no nosso estudo terá a maior importância, isto é, a Lei n.º 98/2009 de 04 de Setembro. Constituindo o conceito de acidente de trabalho, o ponto de partida para o apuramento dos pressupostos da responsabilidade que se impõe determinar e bem assim apurar a indemnização devida ao trabalhador sinistrado, cremos que não poderíamos analisar o instituto da responsabilidade emergente de acidentes de trabalho, sem antes escrever umas breves linhas acerca do seu conceito e requisitos para caracterização do mesmo enquanto tal. Nesta dissertação, procuraremos abordar as questões que diariamente ocupam em larga medida, o universo de casos levados aos nossos Tribunais do Trabalho, mormente os acidentes de trabalho que são concomitantemente de viação e ainda os eventos infortunísticos que ocorrem por causa imputável à entidade empregadora.

At a time when accidents at work are one of the most discussed themes in the Portuguese Labor Courts, it is urgent to determine not only which events are likely to be characterized as work accidents, but also to define in which cases the employer can be responsible, or, in other hand, in what situations he can be exempt from the reparation duty that the law imposes to him. As we will be able to see in more detail, it is curious that such a vast Labor Code as the Portuguese one, which has more than five hundred rules regulating legal and labor situations, does not densify the subject of accidents at work. As we will see, the Portuguese legislator preferred to submit the entire legal regime in force to a single Law, which in our study will have the greatest importance, that is, Law No. 98/2009 of September 4th. The concept of accident at work is the starting point to define the assumptions of liability that determines the compensation due to the injured worker. Because of this reason, we believe that we could not analyze the liability arising from accidents at work, without write a few short lines about its concept and requirements. In this dissertation, we will try to address the issues that occupy a large extent on a daily basis, the universe of cases brought to our Labor Courts, in particular work accidents that are also traffic accidents and also the unfortunate events that occur due to reasons attributable to the employer.
