A projecção do poder normativo europeu e a crise migratória europeia

Abstract

The European migration crisis has been posing challenges to the EU in the sphere of negotiation when confronted with the fundamental values that lie at the core of the acquis communiutaire. This study intends to analyse the projection of normative power in light of the migration crisis, porposing the hypothesis that there is a disruption between European normative principles when observed through the actions carried out by Member States in an attempt to combat the continuous flux of victims of forced migration in their territory. Considering that, both in the academic as in the political debate, the EU has been considered a norm promoting actor, we propose to analyse if the latter’s actions, in the context of the migration crisis, are in accordance with the ‘moral imperative’ of acting coherently with its historical nature and with the principles established in its treaties. For this purpose, we will analyse real cases that will be the base for the study of the projection of normative power in the sphere of the European migration crisis.

A crise migratória europeia tem vindo a colocar desafios à UE na esfera da negociação, quando confrontada com os valores fundamentais que residem no cerne do acquis communautaire. O presente estudo pretende analisar a projecção do poder normativo europeu à luz da crise migratória colocando a hipótese de existir uma disrupção entre os princípios normativos europeus quando observados através das várias ações levadas a cabo pelos Estados-Membros, numa tentativa de combater o fluxo contínuo de vítimas de migração forçada no seu território. Considerando que, tanto no debate académico como no discurso político, a UE tem sido considerada um ator promotor de princípios normativos, propõe-se analisar se as ações da UE, no contexto da crise migratória, se coadunam com o ‘imperativo moral’ de agir de forma coerente com a sua natureza histórica e com os princípios consagrados nos seus tratados. Para tal proceder-se-á à análise de casos reais que servirão de base para o estudo da projecção do poder normativo na esfera da crise migratória europeia
