Acesso ao direito e aos tribunais

Abstract

No presente trabalho de projeto, analisa-se a evolução do Estado e da administração pública por forma a compreender em que medida os mecanismos de acesso ao direito existentes em Portugal, enquanto elementos de um sistema, podem ser melhorados e otimizados, de molde a servir mais adequadamente os cidadãos economicamente mais desfavorecidos. Assim, começamos por explanar o enquadramento concetual e histórico que permitiu alcançar-se o atual statu quo sobre o conceito de Estado e de administração pública. Destacamos que o conceito de Estado não teve sempre o mesmo significado. Variou consoante o tempo e a sociedade em que cada pensador viveu (cfr. Capítulo I). A administração pública tem evoluído substancialmente, registando-se que a cadeia de poder, que antes radicava numa símplice estrutura hierárquica, passou a assentar numa aliança entre a administração pública e as forças vivas da sociedade, para que seja prestado um cada vez melhor serviço aos cidadãos (cfr. Capítulo I). Notamos que a realização de estudos de avaliação de impacto normativo é uma necessidade sentida desde há longo tempo na generalidade das sociedades ocidentais. Portugal tem vindo a encarar a realização destes estudos como tarefa prioritária, especialmente na área da justiça (cfr. Capítulo II). Seguidamente, apresentamos o caso de estudo sobre a avaliação sucessiva do acesso ao direito, elaborado no âmbito da Direção-Geral da Política de Justiça, no qual a autora participou, cujas metodologia, conclusões e propostas procuramos sumariar (cfr. In the present work, we analyze the evolution of the State and public administration in order to understand to what extent the mechanisms of access to existing law in Portugal, as part of a system, can be improved and optimized in order to more adequately serve the economically most disadvantaged citizens. So, we start explaining the conceptual and historical framework that allowed achieving the current status quo on the concepts of State and public administration. We point out that the concept of State did not have always the same meaning. It varied depending on the time and the society in which each thinker lived (cfr. Chapter I). The public administration has evolved substantially, noting that the power, that before was in a hierarchical and simple structure, and came to be based on an alliance between the Government and the private sector, to provide a better and better service to citizens (cfr. Chapter I). We note that the studies of regulatory impact assessment are a necessity felt for a long time in most Western societies. Portugal has come to face the realization of these studies as a priority task, especially in the area of Justice (cfr. Chapter II). Then, we present the case study on the ex post assessment of access to justice, prepared under the direction of Justice policy, in which the author participated, whose methodology, conclusions and proposals we seek to summarize (cfr. Chapter III). The current system, serving its purpose, can be improved by changes in regulatory, administrative and institutional nature
