Abstract

Os acidentes de trabalho são uma matéria de extrema importância a nível social, pelo facto de qualquer trabalhador se poder deparar com a ocorrência de um sinistro, seja no próprio local de trabalho, seja no percurso que realiza entre a sua residência e o local de trabalho e vice-versa. Assim, o legislador decidiu regular em diploma próprio e não no Código do Trabalho, o regime de reparação de acidentes de trabalho e doenças profissionais, mais precisamente a LAT. Atualmente, a maioria dos casos que se discutem nas Secções do Trabalho dos tribunais portugueses dizem respeito a acidentes de trabalho, o que demonstra que tal matéria está sempre na ordem do dia e merece uma especial atenção e análise por parte de todos os intervenientes neste processo, ou seja, o trabalhador, o empregador e a entidade responsável (seguradora). O acidente de trabalho in itinere é uma modalidade de acidente de trabalho, que tem a particularidade de ocorrer fora do local e do tempo de trabalho, pelo que urge analisar quais os aspetos mais relevantes e que mais dúvidas levantam, como por exemplo, se o desvio do trajeto habitual devido à satisfação de necessidades atendíveis do trabalhador é ou não tutelado pelo regime constante da LAT. Para tal, o presente estudo centrar-se-á numa incursão pelo regime do acidente de trabalho in itinere atualmente em vigor no nosso ordenamento jurídico, socorrendo-nos, sempre que necessário, dos entendimentos sufragados pela doutrina e também da vasta jurisprudência existente sobre a referida matéria

The work-related accidents are an extremely important social matter, since any worker can face a disaster, whether it occurs in the workplace, or during the course between his residence and the workplace. Therefore, the legislator has decided to regulate the redressing regime of work-related accidents and professional diseases in a specific diploma called the LAT rather than in the Labour Code. Nowadays, the vast majority of the cases trialed in the Work Sections of Portuguese courts are usually associated with work-related accidents, which displays its omnipresence and clearly calls for a more attentive analysis from all the interveners, that is, the worker, the employer and the entity responsible (the insurance company). The work-related accident in itinere is a specific form of this kind of accidents, whose singularity resides in the fact that it has to occur outside the workplace and off-hours, which is why it is so vital its analysis, mainly if the diversion of the usual route in order to attend to the needs of the worker is regulated by the LAT regime. As such, the present study will analyze the regime of work-related accidents in itinere enforced nowadays, utilizing, whenever necessary, the agreements upheld by the doctrine, as well as the vast jurisprudence pertaining to this matter.
