Abstract

El propósito de este trabajo es analizar la terminología con la que se identificó a la población india a través de una selección de fuentes para el conocimiento del derecho indiano, entre las que cabe mencionar legislación, documentos de aplicación del derecho y memoriales e informes elevados al monarca español. Se trata de conceptos cargados de significado jurídico, en muchas ocasiones con connotaciones peyorativas y que minusvaloraban las capacidades y competencias dela población indígena. La limitación de derechos, y en concreto de privilegios y exenciones reservados a los españoles, pudiera tener su causa en este hecho. La trascendencia que tuvo la asignación de determinados adjetivos y nombres constante el tiempo en la génesis del imaginario del indio ciudadano se evidencia en el proceso de la construcción de una política americana y, especialmente, en el proceso constituyente español de principios del siglo XIX.

The purpose of this paper is to analyze the terminology with which Indian people was identified, through a selection of sources for the knowledge of Indian law, amongst them legislation, documents relating to the implementation of law, memorials and reports submitted to the Spanish king. These are concepts loaded with legal significance, often with pejorative connotations that undervalued the capacities and competences of the Indigenous population. The limitation of rights, and in particular privileges and exemptions reserved to the Spaniards, could have its cause in this fact. The importance of the assignment of certain adjectives and names constantly in the genesis of the Indian citizen’s imaginary is evidenced in the process of building an American policy and, especially, in the Spanish constitutional process in the early nineteenth century.
