Reflexiones sobre la reducción de la conflictividad tributaria en el ámbito europeo a la luz del derecho a la tutela judicial efectiva

Abstract

Siendo el derecho a la tutela judicial efectiva una garantía consagrada a nivel internacional, el presente trabajo aborda el análisis de dos aspectos concretos sobre su protección en el marco europeo desde la óptica tributaria, cuales son, de una parte, la interactuación entre el Tribunal de Justicia de la Unión Europea y el Tribunal Europeo de Derechos Humanos (atendida la doble cobertura de este derecho a través de la Carta de los Derechos Fundamentales de la Unión Europea y del Convenio Europeo de Derechos Humanos); y, de otra parte, la conexión de la tutela judicial efectiva con la cuestión prejudicial y con la protección de terceros con intereses legítimos ante el Tribunal de Luxemburgo, en aras a la reducción de la creciente conflictividad tributaria.

Este trabajo se enmarca en el Proyecto de investigación “Los planes de acción contra la erosión de la base imponible y el traslado de beneficios, y la seguridad jurídica en el ordenamiento europeo e internacional” (PROMETEO/ 2016/053), concedido por la Generalitat Valenciana a grupos de investigación de excelencia.
