Abstract

El presente trabajo tiene una doble finalidad: a) exponer sucintamente la doctrina del “hecho procesal” como núcleo del “objeto del proceso” penal, desarrollada por la dogmática procesal. Esa doctrina segrega una filosofía espontánea y acrítica elaborada por los procesalistas que es preciso exponer y criticar filosóficamente; b) en segundo lugar, se trata de enfrentarse críticamente al reduccionismo formalista de la epistemología judicial analítica que se centra esencialmente en la prueba entendiéndola como “conjuntos de enunciados sobre hechos”. La propuesta y crítica que se realizan en este trabajo están realizadas desde un enfoque gnoseológico constructivista que entiende el proceso penal como un conjunto de operaciones diversas pero concatenadas, tales operaciones prácticas son siempre operaciones normativizadas en las que ocupa un papel esencial la investigación/instrucción judicial, fiscal y policial. This work has a double purpose: Firstly, to describe succinctly the doctrine of 'procedural fact' as the very core of the process’ object, developed by the criminal procedure dogmatic. This doctrine implies a spontaneous and non-critical philosophy that we need to expose and criticize philosophically. Secondly, to confront critically the formalist reductionism of the analytical legal epistemology that focuses essentially on evidence understood as "sets of statements about facts". Our proposal and criticism are based on a constructivist gnoseological approach that understands the criminal process as “a set of various but concatenated operations.” Such practical operations are always legal ones in which judicial, prosecutor and police research/instruction occupies an essential role. Without them there is no process.
