Abstract

El turismo “peer to peer” (p2p) es una de las grandes tendencias globales que está transformando el modo de viajar y consumir. Transporte por carretera, alojamiento, experiencias en el destino, restauración… Prácticamente todos los sectores de la industria turística se han visto ya afectados por la llamada “economía compartida. En particular, las webs p2p han irrumpido con fuerza en el sector del alojamiento, convirtiéndose en pocos años en un amenazante competidor que, según denuncian los empresarios del sector hotelero y de apartamentos reglados, no opera con las mismas reglas del juego que los establecimientos turísticos legalmente registrados, lo que les deja en inferioridad de condiciones. Para los turistas, implica importantes ventajas, si bien no está exento de algunos riesgos importantes, como sucede en caso de incumplimiento por parte del anfitrión de sus obligaciones. Mientras que es un fenómeno cuyas cifras se incrementan por momentos, desde un punto de vista jurídico no hay un planteamiento claro. Entre otras cuestiones, teniendo en cuenta que resulta de aplicación la normativa autonómica. El objeto del trabajo es por tanto identificar la problemática que se genera desde un punto de vista jurídico, en particular en relación con la regulación de estos nuevos intermediarios y con la protección de los turistas.

Tourism "peer to peer" (p2p) is one of the major global trends that is transforming the way of travelling and consume. Transport by road, accommodation, destination experiences, restoration... Virtually all sectors of the tourism industry have been already affected by the so-called "shared economy. In particular, p2p websites have burst in the accommodation sector, becoming in a few years in a threatening competitor for the hotel sector and regulated apartments. They say that this new intermediary do not operate with the same rules that the legally registered tourist establishments, which leaves them in worse conditions. For tourists, it implies significant advantages, although it is not without some important risks, as it is the case of default by the host of their obligation. From a legal point of view there is no a clear approach, although it is a phenomenon whose numbers are increasing. Among other issues, considering that is applicable regional regulations. The aim of this paper is therefore to identify the problems generated from a legal standpoint, particularly with regard to the regulation of these new intermediaries and protection of tourists.
