Abstract

El presente trabajo supone un análisis de la duración de la protección comunitaria de las obtenciones vegetales, así como de las situaciones en las que ésta se extingue por acaecimiento de las causas determinantes de su nulidad y, finalmente, los casos en los que el derecho se podrá anular o cancelar. Resulta de particular relevancia conocer las situaciones en que se puede producir la extinción de la protección comunitaria de las obtenciones vegetales y sus efectos, ya que, dependiendo de las circunstancias, una vez la protección comunitaria haya sido extinguida, el titular de uno o más derechos nacionales en relación con la misma variedad podrá invocar estos derechos, si éstos están todavía en vigor. This paper represents an analysis of the duration of a Community plant variety, as well as the situations in which it is extinguished by the occurrence of the determinants of its nullity and finally, cases in which the law you can cancel or abort. Of particular relevance to know the situations that can cause the extinction of a Community plant variety and its effects, since, depending on the circumstances, once a Community has been extinguished, the holder of one or more rights nationals in respect of the same variety may invoke these rights, if they are still in force.
