El decomiso de las ganancias de la corrupción

Abstract

La práctica de determinados delitos, especialmente los vinculados al fenómeno delictivo de la corrupción, genera por lo general, beneficios económicos para los involucrados. Para privar al corrupto de las ganancias de origen delictivo, el instrumento de mayor eficacia es el decomiso. Sin embargo, es difícil aplicar el término ganancia en la práctica, ya que tiene un significado muy difuso y se basa en un concepto jurídico de límites inciertos. La cuestión es tan amplia que es discutida en la jurisprudencia de algunos países, como Estados Unidos, Alemania e Italia. Este debate gira en torno a dos principios: el principio de las ganancias netas y el principio de las ganancias brutas. En un intento de buscar una aplicación justa y proporcional de estos principios, los tribunales y los parlamentos están trabajando con vistas a dilucidar la cuestión.

The commission of certain crimes, particularly those connected with the criminal phenomenon of corruption, typically generates economical benefits to those involved. In order to deprive them of such gains, the most effective instrument is confiscation. However, the use of the term gains is very intricate, given that it has a very diffuse meaning, being a legal concept of unclear boundaries. The issue has a range so wide that it has been discussed in the jurisprudence of some countries such as United States, Germany and Italy. The debate revolves around two principles: net earnings and gross profits. As an attempt to seek for a fair and proportional application of these principles, courts and parliaments have pronounced themselves so to shed light on the matter.
