Abstract

El fin de la ultraactividad de los convenios colectivos estatutarios puede desembocar en una situación de vacío de regulación convencional colectivo de las condiciones de trabajo. Para evitarlo es posible arbitrar distintos mecanismos entre los que destacan los instrumentos de naturaleza colectiva. Pero si éstos no existen se han apuntado también otras soluciones al grave problema planteado. Una de ellas consiste en la realización del convenio colectivo estatutario fenecido a través de su incorporación al contrato de trabajo, siendo tal el objeto de estudio en este artículo, que trata de delimitar los contornos (las posibilidades y los límites) de esta contractualización. The end of the ultra-activity statutory collective agreements can lead to a situation of collective conventional vacuum regulation of working conditions. To avoid this it is possible to devise different mechanisms among which are the instruments of collective nature. But if they do not exist are also other solutions aimed at severe problem posed. One of them consists in performing the statutory collective agreement deceased through their incorporation into the contract of employment, such being the object of study in this article, which is to define the contours (possibilities and limitations) of this contracting.
